Fisher conference this week

Amid all of the exciting Sackett news, it is easy to forget that the Supreme Court will be deciding whether to grant certiorari in Fisher v. University of Texas this week.  PLF has been involved in the Fisher litigation since the Fifth Circuirt Court of Appeals, and we are cautiously optimistic that the Court will take up this case.  Fisher is a follow-up to Grutter, and asks whether racial preferences can be used by universities to achieve “diversity,” even where race-neutral measures have proven largely effective.  PLF friend Roger Clegg has this excellent op-ed in the National Review this week, asking the Supreme Court to take up the case.
