Geithner hereThat’s the case challenging the Independent Payment Advisory Board, the new agency that exercises virtually unchecked authority over Medicare reimbursement rates.  We argued in this amicus brief that IPAB is unconstitutional.  As Ellis helpfully reminds his readers, the challenge to IPAB might live on even if the Supreme Court rules that the individual mandate is unconstitutional this term, but we will keep up the fight!
