[Past Event] – When Safety Backfires: How Overregulation Can Harm Innovation and Infant Safety

Each year, the federal government issues thousands of recalls—purportedly to protect Americans from potentially defective products.

But a new PLF report shows that when it comes to nursery products, the Consumer Product Safety Commission (CPSC) often takes an overcautious and incoherent approach—treating consumer misuse as a product defect. As a result, the CPSC often removes safe and useful childcare products from the market, while doing little to improve children’s safety.

On August 19, our strategic research team is hosting a brief virtual discussion outlining the key findings from our report. They will be joined by PLF senior attorney Oliver J. Dunford, lead counsel in an ongoing lawsuit against the CPSC. Oliver represents Jaimie Leach, owner of Leachco—a small, family-run business based in Ada, Oklahoma.

For the past three years, Jamie and her team have been navigating a nightmarish ordeal after the CPSC alleged that one of Leachco’s products—an infant lounger called the Podster—was associated with three infant deaths, despite clear evidence that the Podster was misused and not defective in any way.
