PLF’s Obamacare litigation (so far!)

PLF has so far participated in four cases challenging the constitutionality of the Individual Mandate and other aspects of Obamacare. Here’s the list:

  • Florida v. HHS—this is the big case argued before the Eleventh Circuit earlier this week, in which more than half the states are suing the federal government. Here’s PLF’s brief.
  • Virginia v. HHS—this is the case argued last month before the Fourth Circuit; here is the brief PLF filed, and which was mentioned a couple times during the oral argument. And here is the supplemental brief we filed in response to the court’s later order.
  • Seven-Sky v. Holder—this case is pending in the District of Columbia Court of Appeals. Here is the joint brief we filed along with several other pro-freedom groups.
  • Sissel v. HHS—This is the case in which we represent Iowa resident Matt Sissel in challenging the constitutionality of the Individual Mandate. Here is the government’s motion to dismiss, and here is our opposition to that motion. We’re waiting right now for the court to decide that motion.
