Talking about Smith v. U.S. Army Corps of Engineers

The Corps’ decision to withdraw its unlawful exercise of jurisdiction over the Smiths’ dry creek bed—rather than respond to our lawsuit—was picked up by the Associated Press last week as well as by World News Daily.  Both the Santa Fe New Mexican and the Albuquerque Journal also featured it on their front pages.  In a state filled with dry arroyos, it’s not surprising that New Mexican residents would be particularly interested to know where the Corps stands vis-a-vis this type of dry landscape.  Let’s hope the agency learned its lesson—that targetted property owners like the Smiths are willing to call its bluff—and that it will be more careful in future to abide by the law.
