Sacramento River Settlement Contractors update

May 01, 2009 | By DAMIEN SCHIFF

Somach, Simmons & Dunn's Andrew M. Hitchings has this post on Judge Wanger's decision this week to rule in favor of Sacramento River Settlement Contractors.  An excerpt:

[B]ased upon the foregoing determinations, the Court granted summary judgment in favor of the SRS Contractors and the Federal Defendants. The Final Decision constitutes a significant victory for the SRS Contractors in this litigation, and preserves the contract renewals that they entered into with the Bureau in 2005 following an extensive and detailed environmental review process. As such, the SRS Contractors and the Bureau will continue to perform on the SRS Contracts to ensure that the SRS Contractors’ pre-existing senior water rights are honored, and to enable the Bureau’s efficient operation of the CVP.
