Government cannot use permitting power to hijack property rights.

The Supreme Court has repeatedly said that the government must not force landowners to give up property rights for permit approval. And these fundamental rights don’t get less protection depending on which branch of government violates them, whether the permit rules come from a bureaucrat or a legislature.
