Disappointing loss in the Balloon Track case

Yesterday, the Superior Court of Humboldt County heard arguments in Citizens for a Better Eureka v. California Coastal Commission, a case challenging the Commission's assertion of appellate jurisdiction over the Balloon Track cleanup.  At the hearing's conclusion, the court announced from the bench its ruling granting the Commission's demurrer dismissing the case.  A final decision on whether to appeal has not yet been made.  The Eureka local paper has this article on the hearing.
