Overview: This CLE briefing will explore how courts are addressing race-based classifications and the future of opportunity-enhancing policies in education and federal contracting. Discussion will include major recent cases and what these mean for constitutional law and public policy moving forward. Cases analyzed will include Students for Fair Admissions and Coalition for TJ, challenging policies using proxy racial discrimination in admissions policies, and Ultima Services Corporation, challenging the application of a rebuttable presumption of social disadvantage to members of certain racial and ethnic groups when awarding government contracts to minority-owned businesses.
