Court upholds ‘Montana Miracle’

Missoula, MT; March 3, 2025: Montana homeowners scored a major victory for property rights when a state court ruled in favor of the property owners trying to build new housing.
“This is a win for Montanans and property owners everywhere,” said David McDonald, an attorney at Pacific Legal Foundation. “The court saw through the plaintiffs’ attempt to hijack vital constitutional rights like equal protection and due process for their own anti-housing purposes, and correctly recognized that lifting restrictions on people’s freedom to use their own property as they see fit is in no way a violation of their neighbors’ rights. Thanks to our wonderful clients David and Clancy, the ‘Montana Miracle’ can continue.”
The case is MAID v. Montana, and is part of PLF’s work protecting the right to build so that property owners can create much-needed housing across the country.
