Last summer, in Securities and Exchange Commission (SEC) v. Jarkesy, the Supreme Court took a hard look at the decades-old and festering practice known as agency adjudication.
Although there’s still work to be done to end the practice for good, the Court’s decision in Jarkesy dealt a significant blow—restoring Americans’ right to a jury trial when facing certain enforcement actions by federal agencies. One agency that engages in this unconstitutional practice is the National Labor Relations Board (NLRB), which is why countless organizations like Starbucks, SpaceX, and even Pacific Legal Foundation are involved in active suits against the NLRB.
