This afternoon in the salmon biological opinion litigation before Judge Wanger, plaintiffs Kern County Water Agency, Coalition for a Sustainable Delta, Metropolitan Water District, and State Water Contractors filed this document, followed by intervenor California Department of Water Resources' filing of this document. Both sets of parties appear to agree with the Federal Contractors that pending requests for a temporary restraining order and preliminary injunction of restrictions within the salmon biological opinion are moot at present. All parties have reserved the right to seek injunctive relief in the future should circumstances so warrant.
