ObamaCare lawsuits update
Author: Timothy Sandefur
You’ll remember that the federal trial court in Michigan dismissed one of the lawsuits challenging the constitutionality of the Individual Mandate; the case is Thomas More Law Center v. Obama, and it was dismissed on October 7th. That case is now before the Sixth Circuit Court of Appeals—the first of the health insurance mandate cases to reach the appellate courts. Briefs for the plaintiffs have been filed, and friend of the court briefs supporting them. The defendants will file their briefs shortly. You can read more—and read the Cato Institute’s brief—at Cato@Liberty. And here is the Washington Legal Foundation’s brief.
No word yet on when the hearing will be held in our own challenge to ObamaCare.
