Nebraska mother settles lawsuit against state restrictions on home births

Omaha, Nebraska; March 27, 2026: Last week, Nebraska mother Hope Lindstrom reached a favorable agreement under which the State agreed to provide her a religious accommodation that will allow her to have a certified nurse midwife assist with her home birth.
“We appreciate the State’s cooperation to resolve this matter, and we’re thrilled that Hope will be able to give birth at home with the assistance of a certified nurse midwife,” said Joshua Polk, an attorney at Pacific Legal Foundation. “While the law hasn’t changed, we plan to keep working to find solutions on this issue to ensure that all Nebraskans have the same freedom to choose between safe childbirth options that are right for them.”
Hope relocated to Nebraska before her second pregnancy and discovered the State prohibits certified nurse midwives from attending home births. She filed suit represented by Pacific Legal Foundation alleging that Nebraska’s law violates constitutional guarantees of religious freedom and due process.
