Santa Rosa ordinance violating the right to vote may fall tomorrow

On behalf of the Building Industry Association of the Bay Area (BIABA), Pacific Legal Foundation has advanced a constitutional challenge to a Santa Rosa ordinance requiring landowners to annex into a special tax district as a condition on their right to develop their property. This requirement violates California's constitutional guarantee of the right to freely vote on special taxes, as well as the federal guarantee to equal protection of the law. Based upon a tentative decision from the court, PLF is optimistic that we may see a favorable ruling tomorrow at a hearing on our summary judgment motion.
