American Heroes: When the government wipes out your property rights and your family legacy—overnight

March 31, 2026 | By KATE POMEROY

What happens when the government doesn’t just regulate your property, but effectively erases its value?

That’s the reality for John Morgan and his family.

In the latest episode of American Heroes, Kathy Hoekstra sits down with John to unpack a California law (SB 1137) that has shut down access to oil and gas resources—wiping out both the value of private land and a family legacy spanning generations.

“It really just wiped us out totally… It took away all of our rights to enjoy whatever income we could have made off of that product.”

For John, this isn’t abstract policy—it’s personal.

His family’s mineral rights trace back nearly a century, passed down from his grandmother to his father, and now to him and his sister. What was once a reliable source of income—and something to pass on to the next generation—is now effectively unusable. Because at the end of the day, this isn’t just John’s story—it’s something everyone understands: the ability of every family to build something and pass it on.

“It would be like them taking my house and saying, well, we’re not going to compensate you for anything.”

The law bans new oil drilling within 3,200 feet of homes and schools, and imposes other structure restrictions that, in practice, shut down development across vast areas of land.

John says the impact is total:

“We can’t drill new wells… It just totally put the kibosh on any drilling.”

But this fight is about more than one family.

“Somebody has to step up to the plate… I’m sure [other owners] need somebody fighting for their rights as well.”

At its core, the case raises a fundamental constitutional question: When the government destroys the economic value of property, does it have to pay?

For John and his family, the answer is simple—and deeply human:

“They’ve taken away income that we could have given to our kids and our grandkids… And now I don’t have that right to do that.”

This is a story about property rights, energy policy, and the real-world cost of government decisions—but it’s also a story about courage.

Because as Kathy puts it, courage is contagious.
