This case is about whether doctors in one state can speak with their own patients in other states without facing criminal penalties. While each state has its own laws about telehealth, as Dr. McBride explains, California law treats even a simple virtual consultation as the “practice of medicine,” requiring full in-state licensure—turning routine follow-up care into a legal risk.
The impact is real. Those with serious conditions like cancer often rely on out-of-state specialists for guidance, second opinions, and follow-up care. But these rules create barriers where none should exist.
With representation from Pacific Legal Foundation, Dr. McBride and his co-plaintiff are challenging these rules in federal court, arguing that they violate the First Amendment by restricting protected medical speech.
It’s a case about more than licensing—it’s about whether patients can access the care and information they need, no matter where their doctor is located.
